Copyright

™ – Trademark

Indicates that a brand name, logo, or slogan is being claimed as a trademark. It can be used before registration to show ownership intent, but does not grant full legal rights until officially registered.

℠ – Service Mark

Used specifically for services rather than goods. It shows that a particular service is claimed as a unique brand identity and can be used prior to registration.

® – Registered Trademark

Indicates the trademark is officially registered with the Trademark Office. It grants exclusive legal rights to the owner and provides full protection against unauthorized use or infringement.

Usage Guidelines
  • ™ and ℠ can be used without registration.
  • ® can only be used after registration is granted.
  • Using ® without registration is illegal and may attract penalties.

Difference Between ™ and ®

™ (Trademark) is used when you are claiming rights over a brand name, logo, or slogan but the mark is not yet registered. It shows ownership intent and warns others, but does not give full statutory protection.

® (Registered Trademark) can only be used once the Trademark Registry has granted registration. It confirms official recognition and provides strong legal rights in case of infringement or misuse.

In short: ™ = Claiming your brand, ® = Legally registered and fully protected.

Trademark Types
1. Wordmark

A Wordmark is a text-only trademark representing a brand, company, or product name without any logo or design. It protects the word(s) themselves, regardless of style or font.

2. Device / Logo

A Device or Logo mark consists of a graphical symbol, stylised design or visual element representing a brand. It protects the visual identity and helps the brand stand out.

3. Phonetic Similarity

Phonetic Definition focuses on how a mark sounds when pronounced. Even if the spelling is different, a mark that sounds similar to an existing trademark can still cause infringement issues.

Trademark Registration Process

Trademark Registration Process

Here’s How The Trademark Process Works

Your trademark journey broken down into clear, simple steps.

1

Trademark Search
Check if a similar or identical trademark already exists using the Trademark Office database.

2

Filing the Application (Form TM-A)
File the application with applicant details, mark (word/logo) and class of goods/services.

3

Examination by Trademark Office
The Registry examines the application for legal compliance and conflict with existing marks.

4

Reply to Objections (if any)
If objections are raised, a detailed response is filed with clarifications and supporting documents.

5

Publication in Trademark Journal
The mark is published in the Journal for 4 months to invite opposition from third parties.

6

Opposition Proceedings (if any)
If opposed, both parties present their case and the Registry decides based on merits.

7

Registration Certificate Issued
On successful completion, the mark is registered for 10 years and a certificate is issued.
